PMV Blinds TERMS & CONDITIONS (And Guarantee as applicable) January 2020
Acceptance of Order Upon receipt and acceptance of quote and price either by Messages / WhatsApp / E-Mail, PMV Blinds must have an message, e-mail or postal letter accepting detailed works and price quoted. Prices will be valid from 30 days from receipt of quotation. Cancellation your rights for replacement roof windows. If the contract is cancelled by the customer within the 30 day cancellation period and the work has been completed PMV Blinds will be entitled to charge the customer for all reasonable costs incurred by PMV Blinds up to the date of cancellation. If no work has been undertaken any monies paid will be refunded within 30 days of cancellation. Special order items paid for in advance with specific non-standard sizes would mean PMV Blinds will be entitled to charge the customer for all reasonable costs incurred through ordering or production by PMV Blinds. Repair or maintenance contracts
The above information requirements do not apply to repair or maintenance contracts if;
• The contract is a service contract
• The consumer has explicitly requested PMV Blinds to carry out the service for the purpose of carrying out repairs or maintenance or if PMV Blinds are going to perform the contract immediately. However; PMV Blinds still offers a 30 day cancellation period where the contract may be cancelled in full, without penalty, if no work has been undertaken, however any goods purchased through PMV Blinds would be subject to a reasonable handling charge. This can be notified by E mail with a read request receipt or in writing by Recorded Delivery. This applies to all contracts. Please copy and use the form above as a template.
Default or Insolvency of customer
This condition applies if the customer is in breach of any of its obligations under these conditions, or the customer has a receiving order in bankruptcy made against him/her or makes any arrangement with his/her creditors or, being a company, as a receiver, liquidator, administrator, supervisor or administrative receiver appointed over its property or assets or any part of them or if in any order shall be made or any resolution passed for winding up the customer or the customer ceases, or threatens to cease, to carry on business, or PMV Blinds reasonably considers that any of the events mentioned above will occur. If this condition applies then PMV Blinds may, without prejudice to its other rights or remedies, demand immediate payment by the customer of all unpaid accounts and suspend further deliveries and cancel this and any other contract between PMV Blinds and the customer without any liability attaching to PMV Blinds in respect of such suspension or cancellation and debit the customer with any loss sustained thereby.
Payment
Payment is to be made in full upon satisfactory completion of the detailed works as quoted on the day of completion before leaving site by cash or bank transfer. 2 to 30 day terms are available upon request and subject to acceptance by PMV Blinds only. A 20% charge will be automatically be added to the invoice unless PMV Blinds has agreed otherwise i.e. weekends or bank holidays/ personal issues etc. In the event of work not being completed due to faulty stock out of our control, we would require 50% of total invoice and the full balance paid on completion. Payment can be made via Bank transfer made payable to “MR MP VALLE”, or cash, or BACS bank details upon request. Cheques not accepted but if only form of payment then a 5% surcharge will be levied. We reserve the right to charge interest in the event of a late payments. Retention of Title PMV Blinds will remain the sole and absolute owner of all materials supplied under contract until payment is made in full. If the customer is in acceptance for works to proceed however the customer will not be present on site for the visit then payment will payable in advance before the visit.
Installation and service
The customer shall grant PMV Blinds employees access to the premises at reasonable times for carrying out work specified. Due to Health and Safety requirements, a safe working and clear floor area for erection of ladders, scaffolding etc, is required below the window and is the responsibility of the client to ensure prior to the Technician’s attendance at site. This quotation is given on the basis that the window handle can be reached, by hand, from floor level and that there are no access or other restrictions ie; loft hatch/spiral staircase etc. Any site delays due to access or other problems, which are not the fault of PMV Blinds, may be charged at his standard rate per hour that would be notified in advance. PMV Blinds will not undertake, or accept responsibility for, any repair or redecoration work required to the internal lining(s) or existing conditions such as black mould staining on existing windows or walls as a result of service work to prevent water ingress or replacement roof windows. Parking for one service vehicle is required. If only on-street parking is available then all costs may be charged in full unless permits are provided. Congestion Charge and administration charges may also apply.
Guarantee part 1
PMV Blinds undertakes to repair free of charge any goods which are shown to be defective in workmanship within twelve months of installation. PMV Blinds shall be under no liability if: The customer has not paid in full for the goods; or The customer has executed or attempted to execute repairs or alterations to the goods which are not authorized by PMV Blinds; or PMV Blinds has not been notified of any defect in the goods within one month of the effect becoming apparent. If service to mitigate leakage has been conducted upon windows fitted by third parties BELOW the minimum 15 degree roof pitch required by Velux® the PMV Blinds Guarantee does not apply. No guarantee is given as to the elimination of condensation, air infiltration or noise reduction unless covered by VELUX manufacturer’s warranty. VELUX® windows and glass are guaranteed by the Velux® Co Ltd for 10 years from installation. VELUX electrics, blinds and accessories are guaranteed as per current VELUX® guidelines. This guarantee does not cover for breakage of glass after the installation is complete, by physical damage by others or act of God.
All Guarantees; General information; All guarantees are given in good faith and if our report should find that there has been any misuse, damage, signs of tampering or any attempted repairs by any third party, we will render this guarantee null and void, leaving any remedial work to be carried out at a pre-arranged fee, which shall be payable before any work commences. We may, at our discretion re-validate your guarantee, but not past the initial 12 months from the original completion date above. No indemnity is offered by this guarantee by any consequential loss caused by workmanship or glass products. PMV Blinds is currently below the VAT threshold. If any VAT is due because the threshold has been reached, it will be paid by PMV Blinds at no cost to the customer.
PMV Blinds Guarantees are non-transferable.
